End User License Agreement

This End User License Agreement ("EULA" or "Agreement") is a legal contract between you ("User" or "you") and Devin Davidson, P.E., doing business as StampReady ("Licensor," "we," "us," or "our"), governing your use of the StampReady mobile applications, website, and related services (collectively, the "Service"). By downloading, installing, or using the Service, you agree to be bound by this EULA. If you do not agree, do not use the Service.
1. License grant
Subject to your compliance with this EULA, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on devices that you own or control, solely for your personal, non-commercial use. This license does not allow you to use the Service on any device that you do not own or control, and you may not distribute or make the Service available over a network where it could be used by multiple devices at the same time.
2. Restrictions
You agree that you will not, and will not permit others to:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Service except as expressly permitted by applicable law
- Rent, lease, loan, resell, sublicense, distribute, or otherwise transfer the Service to any third party
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use the Service for any unlawful, harmful, fraudulent, infringing, or offensive purpose
- Use the Service to develop a competing product or service
- Attempt to gain unauthorized access to any portion of the Service, other user accounts, or any systems or networks connected to the Service
- Interfere with or disrupt the Service, including sending viruses, denial-of-service attacks, or other malicious code
- Use any automated system (bots, scrapers, crawlers) to access the Service without our prior written consent
- Share your account credentials or allow others to access the Service under your account
- Use the Service to cheat on any exam, including the NCEES Fundamentals of Engineering (FE) exam, the Principles and Practice of Engineering (PE) exam, or any state licensing exam
3. Acceptable use and user-generated content
StampReady has zero tolerance for objectionable content and abusive users. Violations result in immediate content removal and may result in permanent account suspension without refund.
3.1 Your content
The Service includes features that allow you to post, transmit, or share content, including text chat in Study Rooms, feedback submissions, profile information, seller-uploaded practice questions, and comments ("User Content"). You retain all ownership rights to your User Content, but you grant Licensor a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, cache, reproduce, publish, publicly perform, publicly display, reformat, translate, and distribute your User Content solely in connection with operating, providing, and improving the Service.
3.2 Prohibited content
You agree NOT to post, transmit, or otherwise make available any User Content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
- Constitutes harassment, stalking, or intimidation of any individual or group
- Contains sexually explicit, pornographic, or graphically violent material
- Promotes illegal activity, self-harm, violence, or terrorism
- Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party, including reproducing copyrighted exam questions from NCEES, Pearson VUE, textbook publishers, or other sources without authorization
- Contains malware, viruses, or any code designed to damage or interfere with any system
- Is commercial solicitation, spam, chain letters, or unauthorized advertising
- Impersonates any person or entity, including Licensor employees, licensed Professional Engineers, or NCEES officials
- Contains personal information of another person without their consent
- Shares, solicits, or discusses answers to active NCEES exams, state licensing exams, or any other exam in a way that would constitute cheating or academic dishonesty
- Encourages any form of professional misconduct or violation of engineering ethics codes
3.3 Reporting and enforcement
We provide the following mechanisms for users to report objectionable content and abusive users:
- In-app reporting: In any Study Room, tap the ⋯ action menu next to any message and select Report message. Reports are logged with the message content, sender identity, room code, and timestamp.
- In-app blocking: In the same menu, select Block user to immediately hide all current and future messages from that user across all Study Rooms. Blocked users cannot communicate with you in any context.
- Email escalation: For urgent issues, email support@stampready.org with "URGENT: UGC Report" in the subject line.
We commit to reviewing all reports and taking appropriate action within 24 hours of receipt. Actions may include removing content, issuing warnings, temporarily restricting account access, or permanently suspending accounts. We reserve the right, but are not obligated, to monitor User Content at our sole discretion, and to remove any User Content for any reason or no reason at all.
3.4 Your responsibility for User Content
You are solely responsible for your User Content and the consequences of posting or publishing it. By posting User Content, you represent and warrant that: (a) you own or have the necessary rights to post the User Content; (b) the posting of your User Content does not violate any third party's rights; and (c) the User Content complies with this EULA. You agree to indemnify and hold Licensor harmless from any claims arising out of or related to your User Content.
4. Account registration
To access certain features, you must create an account. You agree to: (a) provide accurate, current, and complete information; (b) maintain the security of your password; (c) promptly notify us of any unauthorized access to your account; and (d) accept responsibility for all activities that occur under your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been used to violate this EULA.
You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
5. Purchases and refunds
Some features of the Service may be available for purchase. All purchases made through the Apple App Store or Google Play Store are governed by the terms of those platforms. Refunds, chargebacks, and disputes for in-app purchases should be directed to Apple or Google first, in accordance with their refund policies.
For purchases made directly through stampready.app, refund requests may be submitted to support@stampready.org within 14 days of purchase. Refunds are granted at our sole discretion.
Currently all marketplace purchases within the Service are mocked and do not charge real money. When real payments are enabled, the terms in this section will apply and will be accompanied by additional notice.
6. Exam content disclaimer
StampReady is an independent study platform. We are not affiliated with, endorsed by, or sponsored by the National Council of Examiners for Engineering and Surveying (NCEES), Pearson VUE, or any state licensing board. "NCEES," "FE Exam," "PE Exam," and related marks are property of their respective owners and are used descriptively only.
Practice questions, references, and study materials on the Service are provided for educational purposes only. They are designed to simulate the format and difficulty of licensing exams but are NOT actual exam questions and are not guaranteed to match the content of any specific official exam. Use of the Service does not guarantee passing any exam. Licensure in your jurisdiction is ultimately the responsibility of the user and is granted only by your state's licensing board under its own requirements.
7. Professional engineering disclaimer
Content on the Service, including but not limited to practice questions, worked solutions, reference materials, and explanations, is for educational purposes only and does not constitute professional engineering advice, design, analysis, or judgment. You should not rely on any content in the Service for actual engineering work. Engineering decisions in professional practice must be made by a licensed Professional Engineer applying their own judgment to the specific facts of each project.
8. Intellectual property
The Service, including all content, features, functionality, software, design, text, graphics, logos, icons, images, audio, video, and the selection and arrangement thereof, is owned by Licensor or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
STAMPREADY™ is a trademark of Devin Davidson, P.E. You may not use our trademarks without our prior written consent.
9. Third-party content and services
The Service may contain links to or integrate with third-party websites, services, or content (including but not limited to Supabase for backend services, Jitsi Meet for video conferencing, NCEES, Pearson VUE, and state board websites). Licensor is not responsible for the content, privacy policies, or practices of any third parties. You access third-party content at your own risk.
10. Termination
This EULA remains in effect until terminated by you or Licensor. You may terminate this EULA at any time by discontinuing all use of the Service and deleting your account. Licensor may suspend or terminate your access to the Service, with or without notice, for any reason, including if we believe you have violated this EULA. Upon termination: (a) all rights granted to you under this EULA will cease; (b) you must stop all use of the Service; and (c) sections 3, 4, 7, 8, 11, 12, 13, 14, and 15 will survive termination.
11. Disclaimer of warranties
The service is provided "as is" and "as available," without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Licensor does not warrant that the service will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any defects will be corrected. You use the service at your own risk.
Without limiting the foregoing, Licensor makes no representation or warranty that use of the service will result in passing any licensure exam, and any such outcome depends on factors beyond Licensor's control, including your individual effort, preparation, and the policies of the applicable licensing body.
12. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Licensor, its affiliates, or their respective officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, use, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the service, even if Licensor has been advised of the possibility of such damages.
In no event will Licensor's aggregate liability to you for all claims arising out of or relating to this EULA or the service exceed the greater of: (a) the amount you paid to Licensor in the twelve (12) months preceding the claim; or (b) one hundred US dollars ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of incidental or consequential damages, so some of the above limitations may not apply to you. In such jurisdictions, the liability of Licensor is limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Licensor and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of this EULA; (c) your violation of any third-party right, including any copyright, property, or privacy right; or (d) any claim that your User Content caused damage to a third party.
14. Governing law and dispute resolution
This EULA is governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to this EULA or the Service shall be resolved exclusively in the state or federal courts located in Lubbock County, Texas, and you consent to the personal jurisdiction of such courts.
You agree that any claim must be brought within one (1) year after the cause of action arises, or such claim is permanently barred.
15. Apple-specific terms
The following additional terms apply to your use of the iOS version of the Service, acquired through the Apple App Store:
- Acknowledgment: This EULA is concluded between you and Licensor only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
- Scope of license: The license granted to you for the iOS application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and support: Licensor is solely responsible for providing any maintenance and support services with respect to the iOS application. Apple has no obligation whatsoever to furnish any maintenance and support services.
- Warranty: Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iOS application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iOS application.
- Product claims: Licensor, not Apple, is responsible for addressing any user or third-party claims relating to the iOS application, including: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property rights: In the event of any third-party claim that the iOS application or your possession and use of the application infringes that third party's intellectual property rights, Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.
- Developer name and address: Devin Davidson, P.E., StampReady. Contact: support@stampready.org.
- Third-party terms: You must comply with any applicable third-party terms of agreement when using the iOS application.
- Third-party beneficiary: Licensor and you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
16. Google Play-specific terms
The following additional terms apply to your use of the Android version of the Service, acquired through the Google Play Store:
- You acknowledge that Google is not a party to this EULA and is not responsible for the Service.
- Your use of the Android application is also subject to the Google Play Terms of Service and any other applicable Google terms.
- Licensor is solely responsible for the Android application and its content, maintenance, support, and any product claims.
17. Changes to this EULA
We may modify this EULA at any time by posting a revised version at stampready.app/eula. Changes will be effective on the date stated at the top of the revised EULA. Your continued use of the Service after changes become effective constitutes your acceptance of the revised EULA. If you do not agree to the changes, you must stop using the Service.
18. Severability and waiver
If any provision of this EULA is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the EULA will otherwise remain in full force and effect and enforceable. The failure of Licensor to enforce any right or provision of this EULA will not be deemed a waiver of such right or provision.
19. Entire agreement
This EULA, together with our Privacy Policy, constitutes the entire agreement between you and Licensor regarding the Service and supersedes all prior or contemporaneous communications, whether electronic, oral, or written, between you and Licensor.
